* ‘Buyer’ means the individual or organisation that buys or agrees to buy the Goods from the Seller;
* ‘Contract’ means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;
*‘Goods’ means the articles that the Buyer agrees to buy from the Seller;
* ‘Seller’ means The Bridal wear store, Bride by Design, 2 Silver Street, Warminster, Wiltshire, BA12 8PS.
* ‘Terms and Conditions’ means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.
*Goods ordered may take up to 24 weeks for delivery unless a specific time limit is stated in writing when ordered.
* On ordering a gown, a 50% non refundable deposit is taken; the remaining balance is required within 14 days of the gown being delivered to store. No item leaves the store until full payment is made. No alterations can be carried out until the garment is paid for in full. For all other goods ordered in store, full payment is taken upfront.
*We do not offer storage for gowns; they must be collected from store within 14 days of delivery unless stated otherwise. If not collected within 14 days then Bride by Design has the right to charge a weekly £10.00 storage fee to cover excess insurance costs.
* We accept no responsibility for gowns not fitting when collected due to clients increase or decrease in weight or any other reason beyond our control. All original measurements are kept with order form.
*Cheques are not accepted.
* With standard size dresses Bride by Design orders your gown in relation to our suppliers size chart. You agree by placing your order that the list of your measurements taken by the seller is accurate. Alterations may still be necessary by a seamstress on all gowns. We will use your largest measurement to determine which size to order.
*Every effort is made to maintain consistency but exact colours and shades of fabrics and designs on trim, including lace, cannot always be guaranteed. Silk is a natural fabric, minor variations can occur in the weave and these should not be seen as a fault.
*Accessories purchased elsewhere can only be used during fitting of gowns etc at your own risk. .
* Ordered goods will be checked thoroughly on delivery; if any faults are found, the seller will either correct any issues at no cost to the buyer or the buyer will be offered a replacement.
Items collected must be inspected by the buyer before leaving the shop, any damage incurred after this is the responsibility of the buyer.
*Made to measure gowns may still need some general adjustments due to the factory not having you there to fit to. For this reason we do not guarantee a 100% perfect fit. Hem, shoulder & bodice may need adjustments. See section 5.
* Due to the special nature of our merchandise, there are NO returns, refunds or exchanges. Every sale is a final sale. This Final Sale policy is consistent with industry standards for bridal and special occasion apparel.
*In the event of a wedding being cancelled for any reason whatsoever, we offer no returns, refunds or exchanges. Deposits already paid are non refundable. No monies paid are transferable. With standard dress size orders, the remaining balance must be paid within 30 days of receiving our ‘time of essence’ letter, after which Bride by Design legally has the right to sell the dress on to recoup costs.
This does not apply for ‘made to measure’, ‘split size’ or dresses with any bespoke changes made at the time of ordering (any change made by the factory whereby the dress varies from the shop sample) - in the event of wedding cancellation in this case, the remaining balance MUST be paid within the time stated on the customer invoice.
*We recommend that you take out wedding insurance for any unforeseen circumstances.
*Bride by Design charge an upfront appointment fee of £25.00, this secures your 90 minute, private styling session - this fee is redeemable against your dress if purchased on the first visit.
A payment link will be sent to you at the time of booking or you can pay over the phone. Appointments are not confirmed until payment has been made.
This fee is non-refundable if cancelled with less than 48 hours’ notice.
Bride by Design also offer a complimentary 45 minute appointment for you to come back and try your favourite dress again.
Out of hours appointments are £45.00 and non refundable.
*During fittings, shoes and underwear must be the ones intended for the wedding day. For appointments at Bride by Design please ensure minimal makeup is worn and NO fake tan due to damage to our sample garments.
*Due to the Copyright Laws, photography is not allowed within the store.
*The seamstress is a SEPARATE CONTRACTOR and is not connected in any way with Bride by Design.
*Alterations are completely separate from Bride by Design. Details of a seamstress can be given to you on request.
*Alterations are not included in the cost of a garment. Please schedule an appointment in advance with a seamstress. Before alterations are started an estimate will be quoted to you. Any issue regarding alterations are to be taken up with the seamstress.
* No alterations can be carried out until the garment is paid for in full.
*Bridesmaid dresses & flower girl dresses are NOT made to measure, hem and bodice will almost always need adjusting to fit accordingly.
*Once purchases from Bride by Design have left the premises, any problems must be reported to the seller within 48hours. Where your complaint is initially made orally, you will then be requested to send a written summary of your complaint. We will do our best to resolve any issues asap.
*All sale dresses are "SOLD AS SEEN" therefore it is the Buyers responsibility to check that they are happy with the condition of the dress at the time of purchasing and cannot be returned for any reason.
*All goods remain the property of Bride by Design until they are paid for in full.
* By signing your order form at the time of purchase you are agreeing to our full terms & conditions.
*These Terms and Conditions do not affect your statutory rights.
